You are now connected to the official web site (“this site”) of the World Federation of Advertisers (“WFA”). WFA maintains this site to enable public visitors (“visitors”) and WFA-members (“members”) to access information about its activities and initiatives.

Scope of application

These TERMS OF USE apply to all visitors and members entering this site (“you”), regardless of the physical location of the individual accessing user. By using this site you are expressly accepting these TERMS OF USE. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use this site.

WFA reserves the right to update the TERMS OF USE at any time without notice to you. The most current version of the TERMS OF USE can be reviewed by clicking on the “Terms of Use” hypertext link located on this site pages. Please note that by re-entering this site you accept the updated TERMS OF USE at the time of re-entry on this site.

Throughout this site, WFA provides you with access to a variety of resources, which may include upload and download areas, communication forums and information (collectively “Site Content”). The Site Content, including any updates, enhancements, new features, and/or the addition of any new web properties, are subject to these TERMS OF USE.

All issues relating to the protection of personal data are governed by WFA’s privacy policy.

Communication

Please direct any comments you may wish to make regarding the functioning of this site to webmaster@wfanet.org. However, please note that any messages that you send us via the Internet may be intercepted. Their confidentiality cannot be guaranteed. Therefore, please guard against including any sensitive or personal information in any electronic correspondence with WFA.

The indication of provenance in the electronic mail we receive can be falsified. Therefore, if you wish to communicate sensitive information or any personal data, you should imperatively send us the information by mail.

Confidentiality

Any information only available through the members’ area of this site is non-public and exclusively supplied to members. Therefore, if assigned a username and password to enter the members’ area of this site, members must not disclose or share their WFA password with any unauthorized third party. If a password has been compromised for any reason, it is the member’s responsibility to immediately inform WFA and have its password changed.

Member account, password and security

If you open an account on this site, you must complete the registration process by providing us with current, complete, and accurate information as prompted by the applicable registration form. You also will choose a password and a user name. You are entirely responsible for maintaining the confidentiality of your password and any other non-public account information. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify WFA immediately of any unauthorized use of your account or any other breach of security. WFA will not be liable for any loss that you may incur as a result of someone else using your user name, password, or account, either with or without your knowledge. However, you could be held liable for losses incurred by WFA or another party due to someone else using your user name, password, or account. You may not use anyone else’s account at any time without the permission of the account holder. WFA may disable your user name, password and account in WFA sole discretion without notice or explanation.

Acceptable use

As a condition of your use of this site and the Site Content, you will not use this site and the Site Content for any purpose that is unlawful or prohibited by these Terms of Use. You may not use this site and the Site Content in any manner that could damage, disable, overburden, or impair any WFA’s server, or any networks connected to any WFA’s server, or that could interfere with any other party’s use and enjoyment of any Site Content. You may not attempt to gain unauthorized access to any Site Content, other accounts, computer systems, or networks or to any of the Site Content through hacking, password mining, or any other means. You may not obtain or attempt to obtain any Materials or information through any means not intentionally made available through the Site Content.

You must not use this site in any way that causes, or may cause, damage to this site or impairment of the availability or accessibility of this site; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

You must not use this site to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to this site without WFA express written consent.

You must not use this site to transmit or send unsolicited commercial communications.

User content, submissions

WFA does not claim ownership of any materials you provide to WFA (including feedback and suggestions) or post, upload, input, or any other submission made by you. However, by posting, uploading, inputting, providing, or submitting your any submission, you are granting WFA, its affiliated companies, and necessary sub licensees a worldwide, irrevocable, non-exclusive, royalty-free license to copy, use, reproduce, adapt, publish, translate, transmit, publicly display, publicly perform, edit, reformat and distribute your submission, and to publish your name in connection with your submission, in any existing or future media.  You also grant to WFA the right to sub-license these rights, and the right to bring an action for infringement of these rights. No compensation will be paid with respect to the use of your submissions, as provided herein. WFA is under no obligation to use any submission you may provide. WFA reserves the right to edit or remove any material submitted to this site, or stored on WFA’s servers, or hosted or published upon this site. Notwithstanding WFA’s rights under these Terms of Use in relation to user content, WFA does not undertake to monitor your submissions.

Your submission must not be illegal or unlawful, must not infringe any third party’s legal rights, and must not be capable of giving rise to legal action whether against you or WFA or a third party (in each case under any applicable law). You must not submit any submission that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.

Intellectual property rights

WFA or its suppliers retain all right, title, and interest in and to any and all of its intellectual property rights, this site and the Site Content, including all copyrights, patents, trade secrets, trademarks, and other intellectual property rights. WFA reserves all rights not expressly granted. These Terms of Use do not grant or imply any rights to any WFA or supplier trademarks, trade names, or logos. Any rights not expressly granted herein are reserved.

All materials and components of the Site Content, including documents, images, reports, datasheets and videos, and FAQs (collectively “Materials”) that are made available as part of the Site Content are the copyrighted work of WFA or its suppliers. Your use of these Materials is governed by these terms. WFA reserves all other rights to the Materials not expressly granted under these terms. In your use of the Materials you may not:

  • remove, modify or tamper with any copyright notices;
  • distribute the Materials to third parties, including by posting the Materials on any networked computer for access by any other computer on the network, or broadcast the Materials in any media; or
  • edit or otherwise make any modifications to the Materials;
  • republish the Materials from this site (including republication on another website);

Breaches of these terms and conditions

Without prejudice to WFA’s other rights under these terms and conditions, if you breach these terms and conditions in any way, WFA may take such action as WFA deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

Assignment

WFA may transfer, sub-contract or otherwise deal with WFA’s rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.

You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.

Severability

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.  If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect. The remaining part of the provision will be applicable to the maximum authorized by the law.

Entire agreement

These Terms of Use constitute the entire agreement between you and WFA in relation to your use of this site, and supersede all previous agreements in respect of your use of this site.

Law and venue

These Terms of Use shall be governed by the laws of Belgium, without regard to its conflicts of laws principles. Any disputes arising out of or in connection with these Terms of Use shall be finally settled by the exclusive jurisdiction of the competent courts of Brussels, Belgium using French as language of the proceedings. Notwithstanding anything to the contrary in these Terms of Use, WFA may seek injunctive or other relief in any state, federal, or national court of competent jurisdiction for any actual or alleged infringement of WFA’s intellectual property rights

Competition law compliance policy

The purpose of the WFA is to represent the interests of advertisers and to act as a forum for legitimate contacts between members of the advertising industry.  It is obviously the policy of the WFA that it will not be used by any company to further any anti-competitive or collusive conduct, or to engage in other activities that could violate any antitrust or competition law, regulation, rule or directives of any country or otherwise impair full and fair competition.  The WFA carries out regular checks to make sure that this policy is being strictly adhered to.

As a condition of membership, members of the WFA acknowledge that their membership of the WFA is subject to the competition law rules and they agree to comply fully with those laws.  Members agree that they will not use the WFA, directly or indirectly, (a) to reach or attempt to reach agreements or understandings with one or more of their competitors, (b) to obtain or attempt to obtain, or exchange or attempt to exchange, confidential, proprietary and/or commercially sensitive* information  regarding any other company other than in the context of a bona fide business or (c) to further any anti-competitive or collusive conduct, or to engage in other activities that could violate any antitrust or competition law, regulation, rule or directives of any country or otherwise impair full and fair competition.

*Commercially sensitive information includes but is not limited to: prices, discounts/rebates or other terms offered to customers, information on costs, pricing methodologies, supply and demand (volumes, capacity, output, future investment plans), recent/planned sales figures, revenues and proposed responses to invitations to tender.
